OVERVIEW

Welcome to Maison Em.

These Terms of Service govern your access to and use of the Maison Em website, products, services, AuraKey ecosystem, and related digital channels (collectively, the “Services”).

In these Terms, “Maison Em”, “we”, “us”, and “our” refer to Maison Em FZ-LLC, Dubai, United Arab Emirates.

By accessing, browsing, creating an account, placing an order, or otherwise using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, please do not use our Services.

1. ELIGIBILITY AND ACCOUNTS

You must be at least 18 years old, or the legal age of majority in your jurisdiction, to purchase products through Maison Em.

You are responsible for ensuring that the information you provide to us is accurate, current, and complete, including your name, contact details, billing information, delivery address, and payment details.

You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out through your account.

You may not transfer, sell, assign, or license your account to another person without our written approval.

2. OUR PRODUCTS AND INDEPENDENT FRAGRANCE CURATION

Maison Em is an independent fragrance discovery and curation platform.

All fragrances offered by Maison Em are sourced from genuine retail bottles obtained through legitimate retailers, authorised distributors, verified suppliers, trusted collectors, or approved partners.

Maison Em independently decants, transfers, and rebottles genuine fragrances into its own formats, including AuraKey Refills, Discovery Vials, sample formats, curated sets, and other Maison Em products.

Maison Em does not manufacture, imitate, recreate, dilute, alter, or sell clone fragrances unless expressly stated otherwise.

Maison Em is not affiliated with, endorsed by, sponsored by, or associated with any fragrance brand, trademark owner, designer, or manufacturer featured on the website, unless explicitly stated.

All third-party brand names, trademarks, bottle designs, logos, imagery, and product names remain the property of their respective owners and are used solely for identification, editorial, fragrance curation, and descriptive purposes.

3. PRODUCT PRESENTATION AND ACCURACY

We make reasonable efforts to ensure that product descriptions, imagery, notes, colours, sizes, availability, and pricing are accurate.

However, fragrance bottles, branded packaging, and original retail presentation shown in product imagery may be used for identification and editorial reference only.

Unless expressly stated, Maison Em products do not include the original full-size perfume bottle, original branded packaging, or accessories shown in imagery.

AuraKey Refills, Discovery Vials, and other Maison Em formats are independently prepared and packaged by Maison Em.

Colours, finishes, packaging details, product appearance, and screen display may vary due to lighting, photography, device settings, production batches, and other factors.

We reserve the right to correct product descriptions, pricing, typographical errors, availability information, or other inaccuracies at any time, including after an order has been placed.

4. FRAGRANCE PERFORMANCE AND SAFETY DISCLAIMER

Fragrance performance is subjective and may differ between individuals.

Longevity, projection, sillage, scent development, and overall fragrance perception may be affected by skin chemistry, climate, humidity, storage conditions, application method, and individual sensitivity.

Maison Em does not guarantee that a fragrance will perform identically for every customer.

Customers are responsible for reviewing product information before purchase and using fragrances responsibly.

Do not ingest fragrance products. Avoid contact with eyes, broken skin, flames, heat sources, and children. Keep fragrance products away from direct sunlight and excessive heat.

If irritation, discomfort, allergic reaction, or sensitivity occurs, discontinue use immediately and seek appropriate medical advice where necessary.

Maison Em is not responsible for allergic reactions, sensitivities, misuse, improper storage, or use contrary to product instructions.

5. AURA FRAMEWORK AND RECOMMENDATIONS

Maison Em’s Aura framework, scent classifications, quiz results, fragrance recommendations, editorial descriptions, and content are provided for inspiration, discovery, and personal fragrance exploration only.

Aura classifications and recommendations are subjective, editorial, and proprietary to Maison Em. They are not medical, psychological, therapeutic, diagnostic, or scientific assessments.

We do not guarantee that any recommendation, quiz result, scent profile, or Aura classification will suit every individual or produce a specific result, impression, or emotional outcome.

6. PRODUCT AVAILABILITY

All products and Services are subject to availability.

Maison Em reserves the right to limit purchase quantities, refuse, cancel, or restrict orders, discontinue products or Services, or limit access to products by person, geographic region, jurisdiction, or order volume.

We may cancel orders suspected of fraud, unauthorised resale, abuse, suspicious activity, pricing error, inventory error, or breach of these Terms.

Where an order is cancelled after payment has been received, we will process an appropriate refund in accordance with applicable law and the original payment method where possible.

7. ORDERS AND ACCEPTANCE

When you place an order, you make an offer to purchase the selected products.

Your order is not accepted until Maison Em confirms acceptance by email, dispatch confirmation, or other written confirmation from us.

We may decline or cancel an order where a product is unavailable, payment cannot be authorised, an error has occurred, or we reasonably believe the order is fraudulent or intended for unauthorised resale.

Please review all order details carefully before submitting your order.

Once an order has been accepted or prepared for fulfilment, we may be unable to accommodate cancellation or amendment requests.

8. PRICING, TAXES, AND PAYMENT

All prices are shown in AED unless otherwise stated.

Prices, promotions, discounts, and availability may change without prior notice.

Applicable VAT, delivery fees, and other charges will be displayed at checkout where required.

For international orders, customs duties, import taxes, clearance charges, and other local charges may apply. Unless expressly stated otherwise, these charges are the responsibility of the customer.

Payments are processed through approved third-party payment providers. Maison Em does not directly store complete payment-card details.

By placing an order, you confirm that you are authorised to use the selected payment method and that the payment information you provide is accurate and complete.

9. SHIPPING AND DELIVERY

Delivery timelines are estimates only and are not guaranteed.

Delivery timing may be affected by courier operations, destination, customs procedures, public holidays, weather, security restrictions, incorrect address details, failed delivery attempts, or events outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address, contact number, and any information required for successful delivery.

Maison Em is not responsible for delays caused by shipping providers, customs authorities, incorrect customer information, refusal of delivery, or force majeure events.

Risk in the products passes to you upon delivery to the address provided at checkout, or upon collection by you or an authorised recipient.

Where a delivery is returned to Maison Em because of an incorrect address, refusal, non-collection, or repeated failed delivery attempt, additional shipping charges may apply before reshipment.

10. RETURNS, REFUNDS, AND EXCHANGES

Due to the nature of fragrance products and hygiene considerations, products that have been opened, used, sprayed, unsealed, damaged after delivery, or handled in a manner that affects resale hygiene may not be eligible for return or exchange, except where required by applicable law.

Nothing in these Terms limits any consumer rights that cannot lawfully be excluded.

If a product is defective, damaged in transit, incorrect, or materially different from its description, please contact us promptly at hello@themaisonem.com with your order number and clear supporting photographs where applicable.

We may request that the product be returned for inspection before issuing a replacement, refund, credit, or other remedy.

11. INTELLECTUAL PROPERTY

All Maison Em intellectual property, including our name, logos, branding, copy, website design, content, visual assets, product photography, packaging designs, AuraKey ecosystem, Aura framework, fragrance classifications, editorial concepts, data structures, graphics, and proprietary materials, is owned by or licensed to Maison Em.

You may use the Services for lawful personal and non-commercial purposes only.

You must not copy, reproduce, distribute, modify, publish, sell, license, scrape, data-mine, reverse engineer, create derivative works from, or commercially exploit any Maison Em content or intellectual property without our prior written consent.

All third-party trademarks and intellectual property displayed on the Services remain the property of their respective owners.

12. PROHIBITED USES

You agree not to use the Services for any unlawful, fraudulent, harmful, or unauthorised purpose.

You must not attempt unauthorised access to our website, systems, accounts, or data; use bots, crawlers, scrapers, automated systems, AI agents, data-mining tools, or extraction tools without written permission; interfere with website performance or security; upload viruses or harmful code; impersonate another person; submit false information; resell Maison Em products commercially without approval; or use Maison Em content, imagery, intellectual property, product data, or Aura framework for competing, commercial, or misleading purposes.

We may suspend, restrict, or terminate access to the Services where we reasonably believe that these Terms have been breached.

13. THIRD-PARTY SERVICES AND LINKS

Our Services may contain links to third-party websites, payment providers, shipping providers, social platforms, tools, or integrations.

These third-party services are provided for convenience only. Maison Em does not control and is not responsible for third-party content, policies, availability, accuracy, security, products, or services.

Your use of third-party services is subject to their own terms and privacy policies.

14. PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

By using our Services, you acknowledge that information may be processed by Maison Em, Shopify, payment providers, logistics partners, customer-service platforms, and other service providers where necessary to operate the Services, process orders, deliver products, communicate with you, prevent fraud, and comply with legal obligations.

15. FEEDBACK AND USER CONTENT

If you submit reviews, comments, feedback, suggestions, images, messages, testimonials, or other content to Maison Em, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to use, reproduce, adapt, publish, display, distribute, and promote that content in connection with Maison Em and its Services.

You confirm that you own or have the rights necessary to submit such content and that it does not infringe the rights of another person or contain unlawful, misleading, abusive, defamatory, or harmful material.

We may remove or decline to publish any submitted content at our discretion.

16. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services and products are provided on an “as available” basis.

Maison Em does not guarantee that the Services will be uninterrupted, error-free, secure, or free from technical issues.

Except where expressly required by law, Maison Em makes no warranties regarding the suitability, availability, performance, outcome, or compatibility of any product or Service for a particular purpose.

Nothing in these Terms excludes rights or warranties that cannot legally be excluded.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Maison Em, its owners, directors, employees, contractors, partners, affiliates, licensors, and service providers shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses or damages.

This includes loss of profits, loss of business, loss of opportunity, loss of data, reputational loss, personal dissatisfaction with scent preferences, shipping delays outside our reasonable control, or technical interruptions to the Services.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law.

18. INDEMNITY

You agree to indemnify and hold harmless Maison Em, its owners, directors, employees, contractors, affiliates, partners, licensors, and service providers against claims, losses, liabilities, damages, costs, and expenses arising from your breach of these Terms, misuse of the Services, unlawful conduct, or infringement of another party’s rights.

19. TERMINATION

We may suspend or terminate your access to the Services, account, or ability to place orders at any time where we reasonably believe you have breached these Terms, engaged in fraud, misused the Services, or created risk for Maison Em, other customers, or third parties.

Any obligations that by their nature should continue after termination will remain in effect, including intellectual property protections, limitation of liability, indemnity, and governing-law provisions.

20. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the United Arab Emirates and the applicable laws and regulations of the Emirate of Dubai.

Any dispute arising from or relating to these Terms, the Services, or a purchase from Maison Em shall be subject to the jurisdiction of the competent courts of Dubai, United Arab Emirates, unless applicable law requires otherwise.

21. CHANGES TO THESE TERMS

Maison Em may update these Terms from time to time.

The most current version will be published on this page with an updated “Last Updated” date.

Your continued use of the Services after updated Terms are posted constitutes acceptance of those changes.
